OPE : This document sets out the general terms and conditions governing all sales concluded by the Gallery Le Coin des Arts, registered with the Register of Commerce and Companies of Paris (Registre du Commerce et des Sociétés de Paris) under the number 790 730 709 located at 6 rue de l'Échaudé 75006 Paris, for clients wishing to purchase paintings offered for sale on its Internet site: www.lecoindesarts.com or on site (6, rue de l'Échaudé or 53, rue de Turenne).
CONDITIONS OF THE GOODS : The goods are sold in the state they are in at the time of the sale with any imperfections and defects. It is the responsibility of the buyer to examine each item before the sale and to ask La Galerie Le Coin des Arts about its characteristics and possible restorations. Re-coating, lining, marouflage, parquetry, and all similar operations are conservation operations which cannot in any way be considered as defects that could affect the sale. All works are sold unframed unless otherwise stated in the condition description. No claim can be made for restoration or minor damage.
INTELLECTUAL PROPERTY RIGHTS AND COPYRIGHT : Only the physical property of the work is transferred. The present sale does not in any way imply the transfer of any intellectual property rights or copyright.
GUARANTEE : All the items featured are guaranteed authentic and are sold with a certificate of authenticity (on request). However, a certificate of authenticity is not provided for posters or items under 300 euros.
PRICE : All prices are NET in euros (EUR). They can be modified without notice. Payment is accepted in euros only.
Means of payment accepted in the galleries (6, rue de l'Echaudé ou 53, rue de Turenne) :
Blue card, VIsa, Mastercard or American Express, cheque or bank transfer for France.
Visa, Mastercard or American Express, or bank transfers Swift for abroad.
Means of payment accepted on the website :
Visa, Mastercard, American Express or PayPal (the payment is secured by Ingenico epayment).
OWNERSHIP : Title is transferred after full payment of the goods pursuant to Law No. 80-335 of 12 May 1980.
LATE PAYMENT : Any late payment shall give rise, without the need for a reminder, to the application of late payment interest at the interest rate applied by the European Central Bank to its most recent refinancing operation, increased by 10 percentage points, as well as, for purchasers who are commercial companies, a fixed indemnity for collection costs of 40 euros (excluding VAT), or even, if the actual costs are higher, on presentation of the corresponding receipts, an indemnity for the said costs.
NON-PAYMENT - RESOLUTION OF THE SALE : In the event of non-payment of the price or of any additional costs within 15 calendar days of the issue of the invoice or, in the event that the invoice mentions one or more specific payment deadlines, from the expiry date of the deadline in question, La Galerie Le Coin des Arts will be entitled to cancel the sale as of right, if it sees fit, without prior notice. In the event that a deposit has been paid by the buyer, La Galerie Le Coin des Arts will issue a credit note for an equivalent amount including VAT.
SHIPPING & INSURANCE : Shipping costs are the responsibility of the buyer.
The packaging is neat, the items travel safely (tube, flat or specific packaging).
Each transport is insured by us for the amount indicated on the purchase invoice (up to a maximum of 20,000 Euros). For higher amounts, it will be necessary to take out an additional insurance policy at the expense of the buyer.
For France and international shipments, we ship by DHL in express (delivery in D+1 to D+2) which will bring the package to you. Packaging costs are included in the price.
A fixed price is proposed for France and the rest of the world at 45 Euros including tax. Shipping is free for orders over 1200 Euros including tax. This package is valid for prints and posters without framing. In the case of a shipment with a frame or a heavy work (sculpture) or a bulky work of art, a specific quotation will be proposed.
Shipments are made after receipt of payment.
IMPORTANT : In the event of non-delivery or that an item is missing or damaged, the buyer shall notify the carrier within the prescribed periods (48 hours to seven days depending on the destination, see the terms and conditions of the carrier’s GTCs). Risk transfers from the seller to the buyer upon delivery of the package to the carrier (Incoterm CIP).
CUSTOMS : The payment of customs taxes and customs clearance fees upon arrival of the package in the country of destination is the responsibility of the customer. Of course, Galerie Le Coin des Arts will be able to assist the buyer by liaising with DHL services which usually handles customs clearance.
CLAIMS : In the case of a purchase on the website only, in case of delivery error or apparent defect not reported, claims must be made by email within 8 days (14 days for customers France & EEC) upon receipt of the package. In case of a return request, the shipping costs will then be charged to the customer.
CANCELLATION : Any request to invoke the cancellation right must be made by writing (email) within eight (8) days (14 days for French or EU buyers) upon receipt of the package (compare Law No. 2014-344 of 17 March 2014).
Reimbursement : the item’s purchase price less the return postal or shipping charges, additional packaging, insurance and possible customs duty charges will be credited to the buyer’s account within a period of seven (7) days upon receipt of the package. See the cancellation form to be filled out to this end.
RETURNS : As part of a purchase on the website only, no return shall be accepted without preliminary agreement. After agreement (justified complaint or invoking the cancellation right), the buyer shall be requested to place the items, with all the precautions necessary in the case of rare items and collections, in their original packaging, the instructions for returning an item being provided. In the event of loss or damage of the original packaging, the buyer shall be responsible for providing equivalent packaging. Works that are damaged or soiled as a result of the customer's negligence will not be taken back.
APPLICABLE LAW AND JURISDICTION CLAUSE
All our sales are governed by French law, notwithstanding the client’s country of domicile, the place where the order was made and the place of delivery.
Our GTCs are translated into foreign languages for information purposes only, and only the French text of the GTCs shall apply, where appropriate, over all other versions in a foreign language or any other conflicting document in the event of a dispute.
If one of the terms in our GTC is determined invalid, null and void or inapplicable for whatever reason, this term shall be considered autonomous and shall not nullify the force and scope of other terms of our GTC.
In the event of litigation, the customer will address by priority to the Gallery Le Coin des Arts to obtain an amicable solution. Any dispute concerning the interpretation of the present GTCs, in the absence of a mutual agreement, shall be the exclusive competence of the Tribunal de Commerce de Paris. The liability of the Gallery Le Coin des Arts shall, where appropriate, be limited to the amount of the order.
PERSONNAL DATA PROTECTION : No banking information is saved on the website. Each time you make a purchase, you will have to re-enter this banking information (Visa, Mastercard or American Express card number).
In accordance with the French Data Protection Act No. 78-17 of 6 January 1978 amended by Law No. 2004-801 of 6 August 2004, you have the right to access, rectify and oppose any personal data concerning you. All you have to do is write by mail to Galerie Le Coin des Arts, 6, rue de l'Echaudé 75006 Paris, indicating your name, first name and address.
